The U.S. Commodity Futures Trading Commission won a default judgment on September 30 against two promoters of Fundsz, ordering them to pay more than $31 million for a digital assets and precious metals fraud, the agency said in a press release. The U.S. District Court for the Middle District of Florida found that Brian Early and Alisha Ann Kingrey, Fundsz board members and social media moderators, misled investors about expected profits and risk while steering them into the unincorporated scheme, which solicited funds for purported trading in digital assets and precious metals.
How Fundsz misled investors
The court found that Early and Kingrey made material misrepresentations and omissions about Fundsz’s expected profits, risk of loss, and historical trading performance. They told participants their money would be traded according to a proprietary algorithm and could be withdrawn within 180 days with interest, claims the court rejected. Fundsz operated through its website and social media, where the pair promoted the platform and moderated the community that recruited participants. Once they learned the CFTC was investigating, the regulator said, they began walking back their profitability claims and worked to erase Fundsz’s social media presence.
A $31 million penalty and trading bans
The court ordered Early and Kingrey to pay $15,732,455 in restitution and a separate $15,752,455 civil monetary penalty, and permanently barred them from trading and from registering with the CFTC. The judgment followed consent orders against two other defendants: Rachel Larralde, as representative of the estate of founder Rene Larralde, and Juan Pablo Valcarce. The court found the founder misappropriated investor funds, and his estate was ordered to hand over a residence bought with investor money plus more than $2.7 million in other assets to a court-appointed receiver.
CFTC extends its fraud crackdown
The action resolves the remaining claims in a case the CFTC first filed in 2023 and adds to a string of enforcement moves against investment fraud. It follows the agency’s charges over a $950 million Cash FX Ponzi scheme and the SEC’s recent action against Cryptoaiml and TSAI over fake AI trading bots. The default judgment and consent orders close the Fundsz matter, with the agency cautioning investors against schemes that promise algorithmic trading profits and outsized returns.
