The European Securities and Markets Authority (ESMA) has told MiCA-authorised crypto platforms to stop offering services tied to stablecoins that do not meet the bloc’s Markets in Crypto-Assets rules, and given national regulators three months to clear any remaining customer holdings — an outer deadline of January 8, 2027. The guidance, published October 8 as an opinion to national authorities, does not name specific tokens, but Tether’s USDT is the largest stablecoin that remains outside MiCA authorisation.
The opinion covers the full range of crypto-asset services — trading platforms, exchange services, order execution, transfers, custody, advice and portfolio management — and directs national supervisors to stop platforms from letting EU clients acquire or increase exposure to non-compliant tokens.
What ESMA’s Opinion Requires
Authorised crypto-asset service providers (CASPs) must put technical, contractual and organisational controls in place so that non-MiCA-compliant asset-referenced tokens and e-money tokens — the two categories MiCA uses for stablecoins — do not remain available to clients in the European Union. Platforms should neither maintain, introduce, nor facilitate access to those tokens through any service they offer.
Only a narrow set of wind-down activities may continue: liquidation, conversion, withdrawal, transfer or safekeeping of a client’s existing balance, and those must stay time-limited, risk-based and closely supervised. Buying, promoting or trading the affected tokens is out. The step extends a broader European tightening of stablecoin rules that includes central-bank efforts to widen the stablecoin yield ban.
Why USDT Is the Standout Case
USDT is the largest stablecoin by market value, and it has not secured MiCA authorisation, which makes it the clearest large-scale example of a token caught by the new guidance. PayPal’s PYUSD, the third-largest stablecoin, is likewise unauthorised. MiCA’s stablecoin rules began applying in June 2024, requiring issuers of dollar- and euro-pegged tokens offered to EU users to meet authorisation, reserve, redemption and disclosure standards, while the full platform rules took effect on July 1, 2026.
Several platforms moved early. Revolut already delisted USDT ahead of the EU deadline, and other exchanges have restricted Tether and PayPal stablecoin services for European users. The new opinion extends that pressure from individual platforms to every authorised provider in the bloc.
What the January 8, 2027 Deadline Means
The three-month clock runs from the opinion’s October 8 publication, so national regulators are expected to require remediation of remaining pre-existing exposures as soon as possible, and no later than three months — an outer limit of January 8, 2027. EU users who still hold USDT or other non-compliant tokens on an authorised platform will have to follow that platform’s instructions; some may sell or withdraw during the wind-down, while others could face an earlier cutoff.
ESMA’s reasoning is that keeping non-compliant stablecoins available through authorised platforms would weaken the reserve, redemption, governance and disclosure rules MiCA imposes on authorised issuers. National regulators decide how each platform handles its remaining balances within the three-month outer limit.
