California lawmakers have passed a bill that would prohibit public officials and public employees from issuing meme coins, sending the measure to Governor Gavin Newsom for a final decision. Assembly Bill 2409, authored by Assemblymember Valencia, cleared its last legislative hurdle on August 26 when the Senate approved it on a 40–0 vote and the Assembly concurred in the Senate’s amendments 78–0, according to the bill’s LegiScan record. The measure has now entered the enrolled stage and awaits the governor’s signature or veto.
What AB 2409 Would Prohibit
The bill adds a new chapter to California’s Government Code barring any public officer or public employee from issuing a meme coin. It also reaches the platforms that would list such tokens: beginning January 1, 2027, a digital asset service provider could not list for sale on behalf of, or for purchase by, a California resident any meme coin issued on or after that date that is offered by, or in partnership with, a federal, state or local public official. The state attorney general, district attorneys, city attorneys and county counsel would be authorized to enforce the ban through civil actions seeking injunctive relief and disgorgement.
Why California Is Acting Now
The measure arrives after political meme coins proved costly for everyday buyers. The TRUMP memecoin launched by Donald Trump before his return to the White House ultimately erased billions in value, a collapse BlockchainReporter detailed as insiders extracted roughly $4 billion while nearly a million retail buyers absorbed losses. State lawmakers have framed AB 2409 as a way to keep public trust and public office separate from speculative token launches, an effort that runs alongside federal debates over the CLARITY Act and broader crypto market-structure rules.
What Happens Next
The decision now rests with Governor Newsom, who can sign the bill into law or veto it. If enacted, the prohibition on officials issuing meme coins and the platform-listing restriction would take effect in January 2027. For exchanges and digital asset service providers, the practical question will be how to identify and screen meme coins tied to current or former public officials. Until the governor acts, the measure remains pending legislation rather than settled law.
